Looking for an expert in Florida Replevin Law?
Roy L. Weinfeld, P.A. is a leading law firm in replevin litigation. A few of the clients we have assisted include:
- Aaron’s Sales and Lease Ownership
- Financial Federal Credit, Inc.
- Rent-A-Center, Inc.
- VW Credit, Inc.
Through regular replevin filings, the Firm has established a reputation in Courts throughout the State.
The Firm has assisted clients in the recovery of a variety of items, from freightliners to modular classroom space to big screen televisions.
Client needs are responded to quickly in order to generate the appropriate demand letters, or if needed, file replevin litigation.
Once the suit is filed, the Firm tracks the suit from the Clerk to the Judge back to the Clerk and then to the Civil Sheriff.
When clients have faced debtors who try avoiding or cramming down the lease payment obligations, the Firm has tried to compel them to assume or reject in Bankruptcy Court.
In Florida, the Law allows a Lessor to obtain speedy ex-parte relief. By a verified complaint and posting a bond for twice the amount owed or
fair market value of the property at issue, the Court shall Order a pre-judgment writ. The Court, in its discretion, may issue a Break Order.
Equipped with the Pre-Judgment Writ and Break Order, the Sheriff meets the Lessor’s agent and a locksmith to use the force of the County to recover the rental property.
